Terms of Service
1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Dynamo Engine (“Dynamo”, “we”, “us”) governing your access to and use of the Dynamo command-line tool, websites, and related services (together, the “Service”). By creating an account, installing the CLI, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
2. Eligibility and accounts
- You must be at least 13 years old (or the age of digital consent in your country) to use the Service.
- You sign in through a third-party identity provider (Google, Microsoft, GitHub, or Discord). You are responsible for keeping that account secure.
- You are responsible for all activity that occurs under your account and for keeping your account information accurate.
- One account is for one person or one organization seat; sharing a single seat across multiple people beyond your plan's seat limit is not permitted.
3. The Service
Dynamo is an AI-assisted game-development tool. It runs primarily as a local command-line application that reads your project, talks to AI model providers, and helps you write, understand, and modify code and game assets. Features, plans, and limits may change as the product evolves.
4. Bring-your-own-key and AI providers
Dynamo is provider-agnostic. You connect your own API keys or subscriptions for the AI providers you choose (for example Anthropic, OpenAI, Google, or an OpenAI-compatible endpoint). When you use those providers through Dynamo:
- Your use of each provider is governed by that provider's own terms and pricing, which are separate from these Terms.
- You are responsible for your provider costs, usage limits, and for keeping your keys confidential.
- We do not control, and are not responsible for, the availability, accuracy, or content of any third-party model output.
5. AI-generated output
Dynamo produces AI-generated suggestions, code, and content. AI output can be incorrect, incomplete, insecure, or unsuitable for your purpose. You are responsible for reviewing, testing, and deciding whether to use any output before relying on it, shipping it, or running it against production systems. Dynamo is a tool to assist you, not a substitute for your own engineering judgment.
As between you and Dynamo, you retain whatever rights you have in your own projects and in the inputs you provide. We claim no ownership over your code or game content.
6. Acceptable use
You agree not to:
- Use the Service to violate any law or infringe anyone's rights.
- Reverse engineer, decompile, or attempt to extract source from the obfuscated distribution except to the extent that right cannot be lawfully restricted.
- Resell, sublicense, or redistribute the Service without our written permission.
- Circumvent seat limits, license checks, billing, or other access controls.
- Use the Service to build a directly competing product, or to abuse, overload, or disrupt our infrastructure.
7. Subscriptions, billing, and refunds
- Paid plans are billed through our payment processor, Stripe. By subscribing you authorize recurring charges to your payment method until you cancel.
- Trials, if offered, convert to a paid subscription at the end of the trial unless you cancel beforehand. The applicable trial terms are shown at checkout.
- You can manage or cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current billing period; you keep access until then.
- Except where required by law, payments are non-refundable. We retain billing records as described in our Privacy Policy.
- We may change plan pricing with advance notice; changes do not affect the period you have already paid for.
8. Telemetry and privacy
Dynamo may collect optional, off-by-default usage telemetry and, on this website, privacy-first aggregate analytics. We never sell your data and never use your code or prompts to train AI models. What we collect, why, and how to control it is described in our Privacy Policy, which is incorporated into these Terms.
9. Intellectual property
The Service, including the Dynamo software, branding, and documentation, is owned by Dynamo Engine LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms and your plan. All rights not expressly granted are reserved.
10. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI output will meet your requirements.
11. Limitation of liability
To the maximum extent permitted by law, Dynamo Engine LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or USD 100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Dynamo Engine LLC from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time from your account page. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service and its users. Sections that by their nature should survive termination (for example ownership, disclaimers, limitation of liability, and indemnification) will survive.
14. Changes to the Service and these Terms
We may modify the Service and update these Terms as the product evolves. For substantive changes to these Terms we will provide reasonable notice (for example by email to registered users or a notice on this site). Your continued use after changes take effect constitutes acceptance. The “Last updated” date above reflects the most recent change.
15. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and Dynamo Engine LLC agree to the exclusive jurisdiction of the state and federal courts located in Florida, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.
